By signing in to smAARt Agency Search (“smAARt Search” or the “Platform“), you (“you” or “User“) agree to these Terms of Service (“Terms”). smAARt Search is operated by MediaRadar, Inc. (“MediaRadar,” “we,” or “us“) under its AAR Partners brand. If you do not agree, do not sign in.

  1. About the Platform. smAARt Search is a free service that helps brand professionals discover and connect with advertising and marketing agencies. Agency profiles featured on the Platform are curated under MediaRadar’s AAR Partners brand.
  2. Account and Access. You access the Platform by authenticating through your LinkedIn account, or such other method as we may provide from time to time. You are responsible for maintaining the security of your LinkedIn credentials and for all activity under your account. You represent that you are at least 18 years old and have the authority to agree to these Terms. We may suspend or terminate your access at any time, for any reason, without notice.
  3. Acceptable Use. You agree not to: (a) use the Platform for any unlawful purpose; (b) scrape, crawl, or use automated means to access or extract data from the Platform; (c) attempt to gain unauthorized access to any part of the Platform or its systems; (d) use information obtained through the Platform to build or support a product or service competitive with MediaRadar; (e) misrepresent your identity or affiliation; or (f) interfere with the operation or security of the Platform.
  4. Confidentiality of Search Activity. Your use of the Platform, including any searches you conduct and agencies you view or contact, is treated as confidential.
  5. Data and Privacy. When you sign in via LinkedIn, we receive certain profile information (such as your name, email address, and professional details) as authorized by LinkedIn’s authentication process. We use this information to provide the Platform, communicate with you about the service, and as otherwise described in our Privacy Policy. Our collection and use of your personal information is governed by the MediaRadar Privacy Policy, available at https://www.mediaradar.com/privacy. By using the Platform, you acknowledge and agree to the terms of that Privacy Policy.
  6. Intellectual Property. All content, data, software, and materials on the Platform, including the AAR Partners and smAARt Search names and marks, are the property of MediaRadar and/or its licensors. You may not copy, reproduce, distribute, or create derivative works from any Platform content without our prior written consent.
  7. Agency Information. Agency profiles and related information displayed on the Platform are provided for informational purposes only. We do not guarantee the accuracy, completeness, or reliability of any agency profile. Your decision to contact or engage any agency is at your own discretion and risk. MediaRadar is not a party to any engagement between you and any agency found through the Platform.
  8. Disclaimer of Warranties. THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” MEDIARADAR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT USE OF THE PLATFORM WILL RESULT IN ANY PARTICULAR OUTCOME.
  9. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDIARADAR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. MEDIARADAR’S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE PLATFORM WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
  10. Changes to Terms. We may update these Terms at any time by posting a revised version on the Platform. Your continued use after any update constitutes acceptance of the revised Terms.
  11. Governing Law. These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles. You submit to the exclusive jurisdiction of the federal and state courts in New York County.
